The article 9 of the European Convention on Human Rights (Rome, 1950) enshrines the human right to freedom of thought, conscience and religion. Religious freedom has been acknowledged as the first human right in the Modern Period’s history. Its protection was the result of the need to safeguard the freedom of human conscience from various state or ecclesiastical constraints of the medieval period, which had led to religious wars.
Today, the revival of interest about religions in the western and especially in European societies, is creating new questions and challenges for the legal consequenses of the right to religious freedom. The fact is reflected in the rich recent jurisprudence of the European Court of Human Rights (Strasbourg).
The purpose of this course is to study the European and international legislative texts on the protection of religious freedom as they apply to the judgments of the European Court of Human Rights.
